Do I Need a Workers’ Comp Lawyer to File a Claim?

You may have heard people talk about workers’ compensation lawsuits and how they seem to be prevalent in today’s world. These kinds of lawsuits arise when a company denies an employee’s right to receive financial benefits to cover medical costs in the aftermath of a workplace injury. Under normal circumstances, and indeed quite commonly, the company will pay the medical costs, through their insurance company, after going through all of the proper paperwork. When they refuse, there are grounds for a suit.

The company then contacts the insurance company and the insurance company contacts you to dispense the proper amount of funding.

A lawyer is only recommended if the claim is unjustly denied. Technically, no lawyer is necessary even if the individual decides to pursue a workers’ compensation lawsuit. Having an attorney on your side does drastically increase your chances of success in winning your claim however and is advisable in all situations. Remember that the insurance company will fight back with their own lawyers and you don’t want to be left alone with those odds.
