Tampa Permanent Disability Lawyer

While some workplace accidents are minor, some are major and even catastrophic. A bad accident can leave you with an amputation, brain injury, paralysis, or other disability.

If you are disabled, you may not be able to work ever again. This is called permanent disability and you may be able to receive permanent total disability (PTD) benefits through the state’s workers’ compensation program.

However, these benefits are reserved for severe cases, so qualifying for them can be extremely difficult. Franco Law Firm can provide you with the assistance you need. Learn how our experienced Tampa permanent disability lawyer can help.

How to Qualify

Permanent disability benefits are available to those who have suffered a work-related injury and have reached a state of maximum medical improvement (MMI). This means your condition will not improve any more.

To receive these benefits, you must also be physically incapable of engaging in sedentary employment. In Florida, you are considered permanently and totally disabled if you have:

  • A spinal cord injury that has caused severe paralysis in at least one leg, one arm, or the trunk
  • Amputation of an arm, a leg, a hand, or a foot
  • Serious brain injury resulting in significant communication problems, sensory and motor dysfunctions, or neurological disorders
  • Total blindness
  • Second-degree or third-degree burns on at least 25% of the body or third-degree burns on at least 5% of the hands and face

If you don’t have any of these conditions, you may still qualify for permanent total disability benefits if you can prove your injury restrictions prevent you from engaging in any type of employment, including sedentary positions, within a 50-mile radius of your home. If you’re awarded benefits, you will receive two-thirds of your average weekly wages for as long as your disability continues or until you reach age 75. A determination is often made by reviewing your medical records, restrictions, and skills., so make sure you have a competent lawyer to help you obtain the necessary evidence.
