Who is Eligible?

There are two types of temporary disability benefits. Temporary total disability benefits are awarded to workers who cannot perform any type of work due to injuries they suffered in the workplace. It is up to the worker’s treating physician to determine whether or not the worker is able to perform any type of work while they recover. It is not up to the worker.

There are also temporary partial disability benefits. These are awarded to injured workers who can return to work but with certain restrictions. In order to be eligible, they cannot earn more than 80% of the wages they earned before their injury. For example, working a shorter shift would be a work restriction.

Calculating Wages

Both types of temporary disability benefits are supposed to help with income replacement but they will not replace 100% of your lost wages. Temporary total disability benefits pay for two-thirds of your pre-injury average weekly wages, up to $971 per week. For severe injuries, this increases to 80% of pre-injury wages for six months.

Determining temporary partial disability benefits is a bit more complex. The formula amounts to 80% of the difference between 80% of your pre-injury wages and any wages earned while working with restrictions. For example, if you made $1,000 per week before suffering a work-related injury, you must make less than $800 per week with restrictions. Your workers’ compensation benefits would then be 80% of the difference.
