What to Do If You’re Injured at Work By Another Employee

It feels like workplace injury is pretty common, but work should never feel like an unsafe place. We all know about office drama and how there can be tension in the workplace between almost anyone. Perhaps someone got a big promotion over someone else and there is anger or sadness. This is all natural and normal, however, if another employee injures you out of anger or on accident from negligence it is not normal. There are steps you can take to figure out who is liable and how to seek restitution.

If another employee injures you through violence there are different steps you can take. For example, you can file a workers compensation claim and ask your employer’s insurance to cover lost wages and medical bills. In most workplaces, workers compensation will cover injuries in result of the assault. Make sure to report the injury to your employer and tell them you want to file a workers compensation claim.

You may also want to file a third-party lawsuit against your employer or file criminal complaint with the police against your attacker. It might be important to involve the police if you sustain an injury as a result of workplace violence so that the incident is on record and filed with the police. This is just another form of protection to help you. Including more documentation could be helpful in your workers’ compensation claim. This may also give you a peace of mind if you are fearful of the person that assaulted you. If you take your case to court a judge may ask the employee who attacked you to pay restitution.
