A Car Accident Lawsuit Timeline

Being involved in a car accident can create difficult times for those who are injured as a result. When there a person does sustain an injury in an auto accident, he or she is eligible to file a lawsuit against the person or party responsible for the injury and gain financial compensation for said injuries. Going through this process can be difficult if you are unsure of how to proceed, but thankfully, it is not a process that you need to go through alone.

The first thing you should always do after an accident, after emergency medical treatment of course, is to gather as much information as possible about the accident. This will help you with your case later and increase your chances of success in a claim. Your next step should be, although technically not necessary, to consult with an attorney to help you with the rest of the case. This will also increase your chances of winning. Once you are prepared, you can file the case with the courts, which the attorney can help you with.

The first thing that happens in the lawsuit is that the other party, the one being sued, will be asked to settle. This means that they will be offered to pay a certain flat amount in order to drop all further action. Many choose to take a settlement in order to avoid dragging on the case, and if they do, you will receive the compensation amount and that will be the end of it. If they refuse a settlement, they may either try to negotiate a different amount or completely reject a settlement and the case is taken in front of a civil judge. Proceedings in court tend to take months to resolve and include the gathering of information, determination of liability, and new amount mandated or case dropped.

Again, it is always beneficial to have an attorney on your side that is well-versed in car accident law and can help you win your lawsuit and have you see the compensation that you deserve.
